Abstract:

The article is devoted to the problems of the development of fair competition in the field of intellectual property. In the study, the author attempts to answer questions whether it is appropriate to apply antitrust regulation for the intellectual property rights. The paper summarizes the findings of scientists on the feasibility of antitrust regulation of intellectual property rights as a tool for the development of innovation. I have analyzed the relevance of the forthcoming changes in the regulation of the results of intellectual activity. The article systematizes the capabilities and limitations of methods, which are going to be applied for the introduction of antitrust rules pertaining to the intellectual property rights: mandatory licensing, parallel importing. The author has identified the risks of the realization of these regulations for the market and consumers. The results of the study can be taken into account in the practice of antimonopoly authorities, as well as in further studies related to the improvement of antitrust regulation pertaining to intellectual property.
